Abstract of Judgment and Judgment Liens in Texas: A Creditor’s Guide
Recording an abstract of judgment is one of the first steps many Texas creditors take after winning a lawsuit. Here is how judgment liens work and what they can — and cannot — accomplish.
After winning a lawsuit in Texas, one of the first enforcement steps many creditors take is recording an abstract of judgment. This relatively straightforward process can create a lien against the debtor’s nonexempt real property — and it can be an important part of a broader post-judgment enforcement strategy.
What is an abstract of judgment?
An abstract of judgment is a certified summary of a court judgment. Recording it in a county where the debtor owns nonexempt real property creates a judgment lien on that property.
How long does a Texas judgment lien last?
A Texas judgment lien is generally effective for ten years from the date the judgment was signed. If the underlying judgment is renewed before it expires, the lien period may be extended.
Where to record the abstract
A judgment lien only attaches to real property in the county where the abstract is recorded. If the debtor owns property in multiple Texas counties, the creditor must record the abstract in each county separately.
What property is subject to a judgment lien?
A judgment lien attaches to the debtor’s nonexempt real property. Texas’s homestead exemption is among the strongest in the country — a debtor’s primary residence is generally protected from forced sale to satisfy a civil judgment.
What a judgment lien accomplishes
Recording a judgment lien clouds the title, secures the creditor’s position, and preserves priority. In many cases, it creates pressure that leads to a negotiated resolution.
